Terms and Conditions

For Property Owners advertising on mountsbay.co.uk

  1. These terms and conditions (the terms) constitute a legally binding agreement between mountsbay.co.uk, a trading name of Cadfael Business Solutions Ltd (we/us) and the property advertiser, owner or manager (the owner).
  2. www.mountsbay.co.uk (the site) acts as a medium to introduce potential customers to the owner. We do not become party to any contractual relationship between the customer and the owner. We do not mediate in any dispute that may arise between the customer and the owner. We are under no obligation to investigate complaints.
  3. The contract between the owner and us begins as soon as the owner registers for an account on the site, whether free or paid.
  4. A standard listing enables the owner to upload details for one property together with one associated image. No website links are permitted. No information shall be included about any other property that may be owned, managed or let by the owner or any third party known to the owner.
  5. A premium listing enables the owner to upload details for up to five properties, each with up to 12 images. The owner may provide a website address for each property. The owner may upload late availability and special offers for each property. The owner must be the owner, manager or agent of each of the properties listed. Enhanced features may be displayed at a future date as announced.
  6. Owners managing more than five properties may take advantage of our Premium Plus advertising - details available on request.
  7. The owner agrees not to include any unauthorised website or email links in any part of the descriptive text or images for the property.
  8. Payments can be made to us by bank transfer or Stering cheque drawn on a UK bank account. Payments by cheque may be subject to a clearing period of 10 days before paid advertisements are made live. All payments are subject to VAT at the current rate.
  9. Listings may be deleted and accounts may be closed by the owner at any time, with immediate effect and without prior notice to us. No refunds are given for unexpired parts of paid listings.
  10. Paid listings will not be subject to automatic renewal. Paid listing renewals will only be effected with the express prior consent of the owner. The owner is under no obligation to renew paid advertising on the site. Listings that are not renewed will be removed from the website on the date of expiry.
  11. The owner warrants that they own the copyright to all supplied photographic and textual material used within their property advertisements, or have obtained consent or licence for the lawful use of any material by the legal copyright owner. The owner grants us consent to use, in part or as a whole, any copy or photographic material used within advertisements, royalty free, for promotional purposes including advertisements and public relations purposes. We cannot be held responsible for any infringement of copyright laws resulting from material supplied by owners. Infringement of copyright or of the rights of any individual or entity will not be tolerated and if detected, the listing will be removed from the site immediately and no refunds given. Please ensure that all images and text uploaded are your own work or that you can supply licences for the use of third party images. Any claims brought about by a third party alleging infringement will be passed directly to and will be the sole responsibility of the owner. It is recommended that owners provide unique copy for their listing in order to ensure good visibility in organic search results.
  12. The owner agrees not to upload any information or imagery that may cause offence to others or that is defamatory in any way or that contravenes any law. Offensive, illegal or defamatory material will be removed immediately it is detected and any necessary legal or enforcement steps taken.
  13. The owners warrants that all text and imagery provided to the site are accurate representations of the property. Listing must not contain any false or misleading information.
  14. The owner warrants that the property actually exists and that the owners is authorised to advertise it. The owner will prove their identity to us if any dispute regarding identity or availability of the property arises. Failure to provide owner identity is an automatic breach of these terms.
  15. The owner shall not upload any content that is likely to cause damage to our server, network or site by the nature or size of said content.
  16. The owner must keep their login details secret and not make them available to any third party. We will never request an owner’s login details. Any such requests from any party should be refused and we should be notified immediately of the request. Any unauthorised amendments to the owner listing must be advised to us as soon as possible.
  17. The owner indemnifies and holds harmless us and any related company or individual against any claims that might be brought by any third party against us or related company or individual if it arises in respect of a breach of the terms on the part of said owner.
  18. The site may be altered or amended from time to time without prior notice to improve the quality of the visitor experience.
  19. We cannot guarantee continuous availability of the site. The site may be subject to occasional downtime due to unforeseen technical reasons. We aim to mitigate any periods of downtime.
  20. We are fully compliant with our obligations under the Data Protection Laws. The owner authorises us to provide their contact details to potential customers. We do not publish email addresses on the site but instead use a contact form. The owner accepts that such contact forms can be misused or intercepted by unauthorised third parties and that this abuse is outside our control and as such we will not be held liable for such misuse.
  21. Reproduction of any part of this site either in part or in whole is prohibited and forms a breach of copyright.
  22. We will not accept liability for any loss of profits or any damages arising as a consequence of use of the site.
  23. This contract is deemed to have been made at Cadfael House, Barley Mow Lane, Catshill, Bromsgrove, Worcestershire and the proper law of the contract is English.

For Users Seeking Accommodation on mountsbay.co.uk

  1. These terms and conditions (the terms) constitute a legally binding agreement between mountsbay.co.uk, a trading name of Cadfael Business Solutions Ltd (we/us) and the accommodation seeker (the user). By continuing to use the site, the user signals their agreement to the terms.
  2. www.mountsbay.co.uk (the site) acts as a medium to introduce the user to the holiday property owner (the owner). We do not become party to any contractual relationship between the user and the owner. We do not mediate in any dispute that may arise between the user and the owner. We are under no obligation to investigate complaints.
  3. All information about listed holiday accommodation, including text descriptions and images, is provided by the owner, who warrants the accuracy of that information. Although the owner is contractually obliged to provide accurate information about their property, we cannot be held responsible for any inaccuracies or misleading statements that may appear on an owner listing. Any misleading statements or inaccurate representations may be reported to us via the contact us form.
  4. The user may contact an owner via the site by means of telephone, email (via the contact form provided) or by clicking through to the owner’s website where a link exists. Any such contact is between the owner and user only. The site is not party to any such contact.
  5. The user acknowledges that the email contact form provided on the site can fall victim to interception and misuse by third parties and that the site is not liable for any such misuse or interception.
  6. The user shall not misuse the email contact form in any way and shall only use the contact form for the purpose of securing holiday accommodation. Misuse includes but is not limited to, sending spam emails, unsolicited marketing and the sending of messages which are unrelated to the search for or booking of holiday accommodation.
  7. The user shall ensure that any communication with an owner however so made shall not infringe the law or the rights of any person or entity. It shall not contain any insulting, slanderous or defamatory material.
  8. The user acknowledges that we are not able to guarantee or validate the identity or ownership of an owner. Users must take their own steps to ensure the validity and existence of a property.
  9. We are fully compliant with our obligations under the Data Protection Laws. The owner authorises us to provide their contact details to users.
